for Digital Accessibility Services

Introduction

These general terms and conditions (hereinafter, the "Terms") govern the delivery of services related to digital accessibility (hereinafter, the "Services") by Funka International AB to [Customer]. By using or engaging the Services, [Customer] agrees to comply with these Terms and Conditions.

Generally

The terms and conditions apply to the Services provided by: Funka International AB, corporate registration number 559143-6026, with postal address Co No18, Nybrokajen 7, 111 48 Stockholm, Sweden, unless otherwise specifically agreed in writing between Funka International AB and you as a customer. Sales via funka.com are aimed at corporate customers, organizations, authorities, and other business operators.

Purpose

The Services are primarily intended to evaluate and improve the digital accessibility of [Customer] 's digital assets, including websites, mobile apps, documents, and other digital resources.

Delivery and right of use

Funka International AB will perform the Services in accordance with an agreed plan and schedule. Any changes to the schedule will be communicated to [Customer]. Deliverables of Services remain the property of Funka International AB, but [Customer] will be entitled to use them for its own purposes.

Payment

[The Customer] shall pay Funka International AB in accordance with the agreed costs and payment terms for the Services. Invoices shall be paid within 30 days from the invoice date unless otherwise agreed.

Confidentiality

Both parties will protect confidential information exchanged during the provision of the Services. Funka International AB shall only be entitled, with the written consent of the Customer, to use the Customer's name, logo, and/or the service provided as part of its references or marketing materials. This includes, but is not limited to, use on Funka International AB's website, in presentation materials, in press releases, and on other marketing channels.

Limitation of liability

Funka International AB is not liable for any damages that [Customer] may incur as a result of using the Services. [Customer] is responsible for taking measures to correct deficiencies in digital accessibility.

Funka International AB reserves the right to correct any typographical, graphical, or system errors on the website, such as incorrect product descriptions or specifications. We reserve the right to change information on the website at any time to correct any errors.

Limitations in Funka's accessibility subscription

The subscription refers to one (1) website with one code base unless otherwise agreed. If the website links to other applications or functions with a different codebase, they are not included in the subscription and must be quoted separately.

The subscription form refers to websites. Subscriptions for other digital services can be created and offered separately.

Changes to the Terms

Dispute resolution

Any disputes arising from the Services shall be resolved through negotiation between the parties. If negotiations are unsuccessful, the dispute shall be resolved in accordance with Swedish law at the Stockholm District Court. By using or engaging the Services, [Customer] confirms his/her commitment to comply with these Terms. Funka International AB and [Customer] undertake to cooperate to ensure digital accessibility for [Customer]'s digital assets.

Personal data management and GDPR

In accordance with the General Data Protection Regulation (GDPR), Funka International AB processes personal data. When [the Customer] makes a purchase, he/she agrees that Funka International AB stores and processes [the Customer's] personal data. The purpose of this storage is to fulfill the agreement with the Customer and to enable our operations. Under the GDPR, the Customer has the right to access their registered information. If the stored information is irrelevant, incorrect, or incomplete, the Customer may request that it be adjusted, restricted, or deleted, and Funka International AB will do so to the extent permitted under applicable legislation (e.g., the Accounting Act).
